KOHUMARU TAONGA LIMITED operates as an e-commerce retailer specializing in premium, handcrafted home fragrances and aromatherapy products. Our offerings include, but are not limited to:
- Indoor Fragrances: Reed diffusers, scented candles, wax melts, essential oil diffusers, and room sprays.
- Car Aromatherapy: Vent clip diffusers, hanging perfumes, car scent sprays, and other vehicle-specific air fresheners.
- Accessories & Related Products: Candle holders, diffuser reeds, refill bottles, and related home decor items.
We aim to “craft soothing scents for your cozy home” and provide products that bring “lasting warmth and calm to your daily space.” All product descriptions, images, prices, and availability are provided on the Site and are subject to change without notice. We reserve the right to discontinue any product at any time.

To purchase products or access certain features of the Site, you may be required to create a user account. You agree to:

a. Order Process: Placing an item in your cart does not reserve that item or its price. An order is only formed when we send you an order confirmation email. We reserve the right to refuse or cancel any order for any reason at our sole discretion, including limitations on quantities available for purchase, inaccuracies in product or pricing information, or suspected fraud.
b. Pricing & Currency: All prices are listed in the currency displayed on the Site (e.g., Euro – €) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without notice. We are not responsible for typographical errors regarding price.
c. Payment: You agree to pay all charges incurred by you or any users of your account and payment method at the prices in effect when such charges are incurred. We accept various payment methods as displayed at checkout. By providing a payment method, you represent and warrant that you are authorized to use the designated payment method.

Risk of loss and title for products pass to you upon our delivery of the items to the carrier.

Our return, refund, and exchange practices are governed by our separate Refund and Returns Policy, which is incorporated into these Terms by reference.
Key Acknowledgment: You specifically acknowledge and agree to our policy that we do not offer “refund only” options for non-defective products. Returns of non-defective items are eligible only for store credit or exchange, subject to the terms outlined in our Refund and Returns Policy.
8. Intellectual Property Rights
The Site and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, product designs, logos, and the selection and arrangement thereof) are owned by KOHUMARU TAONGA LIMITED, its licensors, or other providers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Disclaimer of Warranties & Limitation of Liability
a. Products: Our products, especially scented items like candles and diffusers, are intended for personal, consumer use according to their instructions. You must use all products safely, keep them away from children and pets, never leave burning candles unattended, and place them on stable, heat-resistant surfaces. We are not liable for any damage or injury resulting from misuse, negligence, or failure to follow safety instructions.
b. Site Availability: YOUR USE OF THE SITE AND ITS CONTENT IS AT YOUR OWN RISK. THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL KOHUMARU TAONGA LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR PRODUCTS, INCLUDING LOST PROFITS, DATA LOSS, OR OTHER INTANGIBLE LOSSES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED DOLLARS (USD $100), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES, SO SOME OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless KOHUMARU TAONGA LIMITED, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site or products, including, but not limited to, any use of the Site’s content and services other than as expressly authorized in these Terms or your use of any information obtained from the Site.

13. Governing Law & Dispute Resolution
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the courts located in Northland, New Zealand. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
16. Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control (“Force Majeure Event”), including acts of God, war, terrorism, embargoes, governmental actions, strikes, shortages of materials, fires, floods, earthquakes, epidemics, pandemics, or internet/telecommunications failures.
17. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Refund and Returns Policy, constitute the sole and entire agreement between you and KOHUMARU TAONGA LIMITED regarding the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
